1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Mitologic sp. z o.o. ("Mitologic," "we," "us," or "our") regarding your access to and use of our website, services, and applications.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

2. Services Description

Mitologic provides software development services, including but not limited to:

• Web application development
• Mobile application development (iOS and Android)
• Full-stack development services
• UI/UX design
• Consulting and technical support

3. User Responsibilities

When using our services, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials

• Not use our services for any unlawful purposes
• Not attempt to gain unauthorized access to our systems

4. Intellectual Property Rights

4.1 Our Intellectual Property

All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, images, and software, are owned by Mitologic or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

4.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use our services for their intended purposes, subject to these Terms.

4.3 Client Intellectual Property

Ownership and usage rights of deliverables created as part of service engagements will be specified in separate agreements or statements of work.

5. Payment Terms

For paid services:

• Fees will be specified in service agreements or proposals
• Payment terms will be outlined in invoices
• Late payments may incur additional charges
• We reserve the right to suspend services for non-payment
• All fees are non-refundable unless otherwise stated in writing

6. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the course of service delivery. Specific confidentiality terms will be outlined in separate non-disclosure agreements when applicable.

We implement reasonable security measures to protect confidential information but cannot guarantee absolute security.

7. Warranties and Disclaimers

7.1 Service Warranty

We warrant that services will be performed in a professional manner consistent with industry standards. Specific warranties for deliverables will be outlined in service agreements.

7.2 Disclaimer

EXCEPT AS EXPRESSLY PROVIDED, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, or completely secure.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MITOLOGIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount paid by you for the specific services giving rise to the claim during the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Mitologic and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of our services or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause or notice, including for violation of these Terms.

Termination terms for specific service engagements will be outlined in separate agreements.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any disputes arising from these Terms or our services shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved in the competent courts of Poland.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date.

Your continued use of our services after changes become effective constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with any service-specific agreements, constitute the entire agreement between you and Mitologic regarding the use of our services and supersede all prior agreements and understandings.
